Source text - Spanish STATEMENT MADE BEFORE THE UNITED NATIONS COMMISSION ON HUMAN RIGHTS BY WORLD UNIVERSITY SERVICE
Uno de los últimos golpes de estado en Bolivia, el 17 de julio de 1980 dirigido por el Grl. García Meza, instauró un régimen de fuerza que fue denunciado no sólo por organizaciones internacionales como las Naciones Unidas, la Organización de Estados Americanos (OEA), la Asociación Latinoamericana de Derechos Humanos (ALADHU), Amnesty International, sino incluso por el Congreso y Gobierno Norteamericanos, la Comunidad Económica Europea (CEE) y los países del Pacto Andino. Numerosas delegaciones internacionales fueron a Bolivia a constatar las denuncias sobre estas violaciones, entre ellas el delegado especial de la Comisión de Derechos Humanos en octubre de 1981, quién ha elaborado un informe el cual no ha tenido respuesta del Gobierno Boliviano en el plazo estipulado.
Desde julio de 1980 hasta el cinco de septiembrer de 1981, sucesivos intentos de "golpes de estado" concluyeron con la renuncia del Grl. Garcia Meza y el traspaso del Gobierno a una "Junta de Comandantes" el 7 de agostso de 1981, quienes a su vez eligieron a uno de sus miembros, el Grl. Celso Torrelio, como el nuevo Presidente de Bolivia el cinco de septiembre del mismo año.
Esta serie de "traspasos" presidenciales definen el Gobierno del Grl. Torrelio como una continuidad del régimen del Grl. Garcia Meza, pese a las explicaciones que se den en sentido contrario. Continuidad definida no sólo en el marco de los discursos del nuevo Presidente o en los lineamientos economícos y políticos, sino en su actitud frente al pueblo que lo resiste, en las reiteradas violaciones de los derechos humanos en que incurre, etc.
Citaremos los aspectos más importantes de estas violaciones (tanto a nivel general como a nivel universitario) que se produjeron desde el arrivo del Grl. Torrelio (cinco de septiembre de 1981) al poder, dejando de incidir en lo que sucedió anteriormente, durante el régimen del Grl. Garcia Meza, al contrario, sigue sufriendo las consecuencias de las medidas represivas decretadas en ese entonces, sin que el actual Presidente de Bolivia haya podido rectificarlas, demostrando así el continuismo de uno a otro régimen. De esto último podemos citar unos ejemplos:
• El toque de queda y el estado de sitio continúan en vigencia así como las garantías ciudadanas definidas por la Constitución Política del Estado siguen en suspenso, entre ellas podemos citar el amparo, y el habeas corpus. Igualmente se mantienen suspendidos el derecho que tiene el pueblo boliviano de organizarse en partidos políticos. La intervención militar en las universidades se mantiene, quedando así suspendida la autonomía universitaria y el co-gobierno, derecho inalienable no sólo de los estudiantes sino de todo el pueblo boliviano.
• Las radio-emisoras mineras y fabriles fueron destruidas o con-fiscadas en agosto de 1980 y hasta ahora no se autoriza nuevamente su funcionamiento.
Ante estos ejemplos se podría argumentar que el actual régimen ha hecho promesas de resolver esos problemas. Mientras las promesas no se materialicen, las violaciones de esos derechos seguirá presente.
Entre septiembre y octubre de 1981 se detuvieron a más de 65 personas de diferentes sectores sociales, casi la mitad de ellos correspondía a estudiantes universitarios, habiendo sido muchos de ellos exilados o residenciados. Según Amnesty, los agentes del SES (actual DIE, aparato represivo del estado) tenían libre acceso a las salas de lectura de la Universidad. El rector de la Universidad Mayor de San Andrés-La Paz, Luis Fernando Valle, dijo a los estudiantes que no podía dar garantías para que cesaran las detenciones. Posteriormente, el mismo rector, amenazaba con clausurar la Universidad (25 de noviembre de 1981).
Se tienen informaciones de que en los sótanos y el último piso de la Universidad de la Paz funcionan oficinas de los organismos represivos del régimen. Los rectores de las ocho universidades han sido nombrados e impuestos por el Gobierno, yendo en contra de las normas legales para sus nombramientos. Igual cosa sucede con los catedráticos. Los canales de la televisión universitaria han sido igualmente intervenidos. Los estudiantes están impedidos de elegir, democráticamente, a sus propios repesentantes. Muchas asambleas estudiantiles han sido disueltas de manera violenta. El dirigente Nilo Ramos fue detenido, junto a otros estudiantes, a principios de este año.
La Comisión Interamericana de Derechos Humanos de la OEA elaboró un informe sobre Bolivia, que fue discutido en la Asamblea General de esta Organización en diciembre de 1981. Este informe indica que el Gobierno militar de Bolivia desconoce las garantías constitucionales relativas a la protección de los derechos humanos. El derecho a la vida, a la libertad y la seguridad personales de los bolivianos ha sido frustrado: en la práctica las libertades y derechos fundamentales no son respetados. El Gobierno de Bolivia no dio ninguna respuesta a este informe durante el período establecido.
El 18 de noviembre se declaró una huelga de mineros en Huanuni. Despúes de haber declarado esta huelga ilegal, el Gobierno envió tropas a Huanuni, resultando arrestados entre 50 y 200 mineros. Las reinvindicaciones de los huelguistas eran: a)restablecimiento de los derechos humanos, incluyendo el derecho a la huelga, b)libertad de emisión de las radio-emisoras mineras, c)aumentos salariales, d)amnistía política-sindical.
La huelga concluyó con un acuerdo entre mineros y el Gobierno con la mediación de la Iglesia. Paralelamente familiares de los mineros iniciaron una huelga de hambre, para lograr la liberación de los presos. Posteriormente, el 14 de diciembre se inició otra serie de huelgas de hambre de trabajadores fabriles y el pueblo en general de Cochabamba, La Paz y Santa Cruz, solicitando una amnistía total. El Gobierno no accedió a estas demandas.
Agentes y representantes del Gobierno de Bolivia han declarado en varias ocasiones que no hay prisioneros políticos en este país. Sin embargo, informaciones provenientes de varias organizaciones como Amnestía indican que detenciones de eprsonas sospechosas de oponerse al régimen continúan. Muchas detenciones son realizadas sin orden de aprehensión por la Dirección de Inteligencia del Estado, organizado en base a grupos paramilitares.
En el período indicado además de las detenciones masivas que han ocurrido, también se han llevado adelante asesinatos por parte de agentes del DIE o por miembos del Ejército (casos de Humberto Victoria, Julio Cosio, Félix Filiberto Rivera).
Desde el mes de noviembre de 1981, diferentes organizaciones nacionales (iglesia, asamblea de derechos humanos, etc.) e internacionales fueron solicitando al Gobierno de dictación de una amnistía general e irrestricta. Estas solicitudes han sido rechazadas por el régimen manteniéndose, hasta ahora, no sólo presos y perseguidos al interior de Bolivia a muchos ciudadanos, sino en el exilio a miles de ellos.
Durante la fiesta de año nuevo, 34 personas, entre ellos 15 universitarios, fueron detenidos acusados de participar a una reunión política. Ellos fueron sometidos a interrogatorios y "excesos por parte de los agentes del DIE", según denunciaron sus parientes. La Nunciatura Apostólica y la Embajada de los Estados Unidos tuvieron que intervenir para lograr la libertad de algunos de ellos.
El 15 de enero de 1981, el régimen de Garcia Meza mediante sus grupos paramilitares asesinó a ocho patriotas bolivianos, miembros de la Dirección Nacional del Movimiento de la Izquierda Revolucionaria (dirigentes sindicales, universitarios e otros). El actual régimen no ha dispuesto ninguna medida que permita el esclarecimiento de este hecho y la sanción de los autores; mas al contrario, el 15 de enero de este año la Policía disolvío, violentamente, la romería que realizaban al cementerio sus familiares y amigos.
El seis de febrero de este año se han dictado una serie de medidas económicos que van desde la devaluación del peso boliviano en un 76 por ciento hasta el aumento de precios en el transporte y la energía eléctrica; con todas las consecuencias que esto implica en el aumento de los precios de los principales productos de subsistencia. Ante este hecho, que no es otra cosa que la violación de la economía del pueblo, los sectores populares han reaccionado en legítima defensa realizando paros de protesta, durante los cuales se detuvo a un gran número de dirigentes y ciudadanos. El pasado 16 de febrero agentes del DIE intervinieron violentamente las oficinas de la Conferencia Episcopal, deteniendo a 34 personas que realizaban una huelga de hambre por reconquistar sus derechos más elementales.
Translation - English On July 17th 1980 General García Meza led a military coup in Bolivia and installed a repressive regime which was condemned not only by international organizations such as the United Nations, the Organization of American States (OAS), the Latin American Association for Human Rights and Amnesty International, but also by the Congress and Administration of the United States, the European Economic Community and member States of the Andean Pact. A number of international fact-finding missions were sent to Bolivia to investigate the alleged violation of human rights, among them a special envoy appointed by the United Nations Commission on Human Rights, who visited Bolivia in October, 1981. He drew up a report on his findings but the Bolivian Government failed to react to it within the time period stipulated.
Between July 1980 and September 5th 1981 successive attempts to "overthrow" the Government finally led to the resignation of General García Meza and to the establishment of a military junta on August 7th 1981. On September 5th the Junta elected one of its own members, General Celso Torrelio, as Bolivia's new president.
These so-called transfers of power reveal that the Torrelio Government is merely a continuation of the regime installed by General García Meza despite arguments to the contrary. This is reflected not only in general Torrelio's speeches and economic and political policies but also in the Government's attitude toward the Bolivian people, who are opposed to the regime, and in the Government's persistent violation of human rights.
We intend to highlight some of the most serious human rights abuses in general and those which have been committed in the university since General Torrelio came to power on September 5th. We shall not mention the previous violations under the Meza regime, which are well known to all.
This is not because we want to give the impression that the Bolivian people have forgotten the hardships they experienced under the regime of General García Meza; on the contrary, they are still victims of the repressive measures decreed at that time and which the present Government has still not abolished, demonstrating once again that one regime is perpetuated in the other. We can give several examples of this. For instance, the curfew is still enforced, the Government has not lifted the state of siege and rights such as amparo and habeas corpus guaranteed to Bolivians in the Constitution remain suspended. The Bolivians' right to form political parties has also been denied them.
The military continue to maintain their presence on university campuses, thereby suspending the universities' rights to autonomy as well as the right of students and professors to participate in the government of their institution, an inalienable right not only for university students but for all Bolivian citizens as well.
In an attempt to legitimize the abuses to which the universities have fallen victim, the Torrelio Government has set up a new administrative structure for the universities as defined in the "provisional university statue" based on decree 18187 of April 13th 1981 which remains in effect.
The miners' and factory workers' radio stations were either taken over or destroyed in August of 1980 and have still not been allowed to resume operation.
While some may argue that the present regime has promised to resolve these problems, so long as these promises remain unfulfilled human rights will still be violated in Bolivia.
Between September and October of 1981 more than 65 people, almost half of them university students, from various social classes were detained by the Government; many of them were forced into exile or placed under house arrest. According to Amnesty International, security agents of the Servicio Especial de Seguridad (SES)(Special Security Service)--the regime's repressive force later replaced by the DIE, Departamento de Inteligencia del Estado (State Intelligence Service)--had free access to university lecture rooms. The Rector of the Universidad Mayor de San Andrés in La Paz, Mr. Luís Fernando Valle, told students that he could not give them any guarantees that the arrests would cease. Later, on November 25th 1981 Mr. Valle threatened to close down the University.
According to reliable sources, the Government's repressive forces are operating out of offices located in the basement and on the top floor of the university building in La Paz. Bolivia's eight universities were obliged to accept new rectors who were appointed by the Government in violation of the legal norms established for such nominations. University professors have suffered a similar fate. Furthermore, television stations operated by the University have been taken over the government. Students are forbidden from organizing free elections for their own university representatives and a number of student meetings have been broken up by force. Towards the beginning of this year, student leader Nilo Ramos and other students were detained by the Government.
The OAS Inter-American Commission on Human Rights drew up a report on Bolivia which was discussed at the organization's general assembly meeting in December 1981. This report clearly demonstrates that the present military regime in Bolivia has disregarded constitutional guarantees for the protection of human rights. The right to life, freedom and personal security to which all Bolivians are entitled have been destroyed and, in practice, fundamental rights and liberties are not respected. The Bolivian Government, however, did not react to this report within the period set forth.
On a number of occasions agents and representatives of the Government have stated that there are no political prisoners in Bolivia. Nevertheless, according to information from various organizations including Amnesty International arrest of suspected opponents of the regime continue. Many of these detentions are carried out without warrants by the Government's intelligence service, which is composed of paramilitary corps.
During the period under consideration, in addition to the massive arrests, agents of the DIE (State Intelligence Service) and members of the Army have carried out assassinations, the victims of which include Humberto Victoria, Julio Cosio, and Felix Filiberto Rivera.
On New Year's Eve of this year 34 people, 15 of whom were university students, were detained. They were accused of participating in a political meeting. According to accusations made by their families, the detainees were subjected to interrogations and suffered abuses from the agents of the DIE. The Holy See Embassy as well as the United States Embassy were obliged to intervene to secure the release of some of those detained.
On February 16th 1982 agents of the DIE raided the offices of the Episcopal conference and detained 34 people who were on a hunger strike in an effort to recover their most basic rights.
Since November 1981 various national institutions such as the Church and the Assembly for Human Rights have joined several international organizations in asking the Government to grant a general and unlimited amnesty. These requests have been rejected by the regime which continues to imprison and persecute
Bolivians inside the country on a large scale and to force thousands of others into exile as well.

Prior to that I worked at the Geneva-based Office of the United Nations as a multilingual guide. Following my translation studies I worked as an administrative assistant for a non- profit based in Geneva called World University Service. It was an agency that promoted educational rights for refugee students and community development projects in developing countries. It was at the forefront of efforts to end apartheid in South Africa. In 1985 I joined the US Foreign Service as a consular officer. I served 3 tours in Mexico City, Washington DC, and New York City where I worked for 2 years as a political officer at the US Mission for the United Nations. Since then I have gained experience working as a free-lance translator and as an admin for the Department of Vocational Services at the Maine Medical Center in Portland, Maine. At Maine Medical Center I worked in the area of vocational rehabilitation for people with disabilities and especially for people with psychiatric disabilities.
