Thank you very much for your brief message as of 19th April regarding the
above mentioned query and your support and patience so far.
In order to support you in finding the reasons for this query we thought it
might help you if we provided you with all the details of what went wrong
originally with this trade so that you are able to find the relevant points
to solve this issue.
On 2nd May 2005 one of our traders called your office in Frankfurt and sold
to you a nominal value of 10,000 Securities in the ISIN NL0000423994 ABN
Amro Mini Shares Oil with a price of 17.11 Euros which gives a total amount
of 171,100.00 Euros. The dealers agreed on Settlement on the 4th May and
that we should put in an instruction to transfer the securities to you and
get the money in return via your Clearstream Banking Frankfurt account 7570
and respectively our Clearstream Banking account 4079.
As our trader passed this trade to us we somehow forgot to put in this
instruction and therefore the securities never were delivered to ABN- Amro
and due to that fact we never received the money.
Unfortunately we never got any message from your company that this trade
wasn't matched and so we got only the call price of 60,100.00 Euros last
September as your company used its right to repurchase the security prior
to maturity because of a clause in the offering terms. As we did not get
any message from Clearstream Banking about the purpose of this payment we
never realised the deficit we encountered through this trade until last
week. We then discovered that the above mentioned trade was never settled
and so we got a shortfall of 110,000.00 Euros so far through this which is
the reason why we are urgently waiting for the result of your
investigation. We have already informed your Frankfurt branch and your
middle Office in London and both told us that they can see this trade as
settled in your systems. Perhaps this has partly to do with the fact that
we bought from you 10,000 securities in the same ISIN on 6 May with a sum
of 165,600.00 Euros which was settled well.
If we can be of any help to you to solve this allegement please do not

Um Dir zu helfen den Grund zu finden für diesen Fall, haben wir uns überlegt, dass es wir Dir nochmals alle Details mitteilen von diesem Geschäft und was daran falsch gelaufen ist in der Hoffnung, dass es Dir einen Hinweis gibt wo Du nach dem Fehler suchen kannst.
Am 02. Mai 2005 hat einer unserer Händler Euer Büro in Frankfurt angerufen und an Euch einen Nominal Betrag von 10.000 Stücken in der ISIN NL0000423994 ABN Amro Mini Shares Oil mit einem Preis von 17,11 Euro verkauft. Dies ergab eine Gesamtsumme von 171.100 Euro. Euer Händler und unserer kamen überein, dass dieses Geschäft am 04. Mai gesettled werden sollte und das wir die Weisung zum Übertrag der Stücke an Euch einstellen sollten zugunsten Eures Clearstream Banking Frankfurt Konto 7570 und im Gegenzug das Geld erhalten sollten auf unser Clearstream Banking Frankfurt Konto 4079. Als unser Händler das Geschäft dann an uns gab, haben wir aus einem nicht nachzuvollziehenden Grund vergessen, die Weisung zu erteilen weshalb die Stücke niemals geliefert wurden und wir das Geld nie erhalten haben.
Leider haben wir aus Eurem Haus auch keine Nachricht bekommen das dieses Geschäft nicht beliefert wurde und als Folge daraus haben wir im September nur den Endbetrag von 60.100 Euro bekommen, da die ABN Amro von Ihrer in den Emissionsbedingungen enthaltenen Klausel gebraucht machte und das Zertifikat vor der Endfälligkeit zurücknahm. Weil wir von Clearstream Banking nie eine Nachricht erhielten über den Zweck der Zahlung haben wir das oben erwähnte Geschäft bis letzte Woche nie als Ursache in Betracht gezogen.
Wir entdeckten dann dass das oben erwähnte Geschäft niemals geschlossen wurde und wir bedingt dadurch einen Fehlbetrag in Höhe von 110.000 Euro erlitten haben. Das ist auch der Grund warum wir sehr dringend auf das Ergebnis Deiner Nachforschungen warten.
Wir haben schon Eure Geschäftstelle in Frankfurt angerufen und Euer Middle Office in London und beide teilten uns mit, dass dieses Geschäft in Euren Systemen als gesettled steht. Dies könnte zum Teil vielleicht damit zu haben, dass wir am 6. Mai 10.000 Stücke derselben ISIN mit einem ausmachenden Betrag von 165.600 Euro gekauft haben und dieses Geschäft wurde ordnungsgemäß geschlossen.
