נכס לא ראוי לשימוש
תקציר
בהתאם לקבוע בחוק (סעיף 330 לפקודת העיריות) נכס שנהרס לחלוטין או נכס שניזוק כך שלא ניתן כלל להשתמש בו, ואין משתמשים בו - ניתן לקבל בגינו פטור מארנונה.
תוכן
יש לשים לב כי החוק קובע שהפטור מארנונה ינתן רק מיום מסירת הודעה על כך לעירייה ולא מיום היות הנכס לא ראוי לשימוש. מתן ההודעה לעירייה נעשה על גבי טופס מתאים, או בדרך של הגשת השגה על חיוב הארנונה.
ביום 2.8.2012 פורסם תיקון לסעיף 330 לפקודת העיריות (בתחולה מיום 1.1.2013), לפיו נכס שנהרס לחלוטין, או שניזוק כך שלא ניתן כלל להשתמש בו ואין משתמשים בו יהא זכאי לפטור לתקופה של עד שלוש שנים בלבד. החל מהשנה הרביעית (קרי, 1.1.2016), גם אם לא חל שינוי במצב הנכס, יחויב הנכס משך חמש שנים בהתאם לתעריף המינימלי שנקבע על ידי שר הפנים, ולשימוש האחרון שבוצע בנכס בהתאם לסיווגים שנקבעו בתקנה 12 לתקנות הסדרים במשק המדינה.

חשוב לציין כי תיקון סעיף 330 לפקודת העיריות אינו מקנה באופן אוטומטי מתן פטור לנכס שאינו ראוי לשימוש, והפטור עדיין תלוי בבחינה אובייקטיבית של מצב הנכס. כן יובהר כי תקופת שלוש השנים האמורה, בה הנכס יופטר מתשלום ארנונה תחושב בין אם במצטבר ובין אם ברציפות ובשנים שקדמו ליום הגשת הבקשה.
לדוגמא, נכס שהוכר כלא ראוי לשימוש והופטר מתשלום ארנונה בשנים 2013, 2014 ו-2015, כלומר, לאורך שלוש שנים ברציפות יחל להיות מחויב החל מיום 1/1/2016 לפי התעריף המינימאלי בסיווג המתאים לשימוש האחרון לנכס; נכס שהוכר כלא ראוי לשימוש והופטר מתשלום ארנונה לסירוגין בשנים 2013 - 2014, ושוב בשנת 2016, יחלו להיות מחויב החל מיום 1/1/2017 לפי התעריף המינימלי בסיווג המתאים לשימוש האחרון בנכסים.

בנוסף קובע התיקון כי באם לא חל שינוי במצב הנכס, לאחר חמש שנות החיוב לפי התעריף המינימלי, יש למסור לעירייה הודעה על כך, והנכס יזכה בשנית לפטור מלא ללא מגבלת זמן החל מיום מסירת ההודעה לעירייה. גם במצב זה שלאחר חמש שנות החיוב, קבלת הפטור מותנית בבחינה אובייקטיבית של מצב הנכס, והוא אינו מוענק באופן אוטומטי.
לצורך הגשת הבקשה מומלץ לצרף לטופס מסמכים תומכים כולל תמונות של הנכס, ויש למלא הטופס ולחתום עליו בפני עו''ד / רשם ביהמ''ש שיאשרו בחתימתו, או להגיש טופס השגה מלא וחתום.

Résumé
Conformément à la Loi (article 330 Ordonnance sur les municipalités), une propriété complètement détruite ou endommagée, de telle sorte qu’elle ne peut en aucun cas être utilisée, peut recevoir en sa faveur une exemption de taxe foncière.
Contenu
Il faut relever que la Loi prévoit que l'exemption de taxe foncière ne sera accordée qu'à partir du jour de transmission à la mairie d'une déclaration à cet effet, et non à partir du jour où la propriété est devenue inapte à l'utilisation. Une déclaration à la mairie doit être donnée au moyen du formulaire adéquat, ou par l’intermédiaire d'une contestation sur la redevance d'impôts fonciers.
En date du 2.8.2012, a été communiquée une révision de l'article 330 de l'Ordonnance sur les municipalité (en vigueur dès le 1.1.2013), selon laquelle une propriété complètement détruite ou endommagée, de telle sorte qu’elle ne peut en aucun cas être utilisée et qui ne fait l'objet d'aucune utilisation, n’a droit à une exemption que pour une période maximale de trois ans. A partir de la quatrième année (c.-à-d. 1.1.2016), même si aucun changement n'intervient dans l’état de la propriété, la propriété sera imposée pendant cinq ans conformément au taux minimal fixé par le Ministre de l'intérieur, et en fonction de la dernière utilisation du bien, selon les classifications prévus au règlement 12 des règlements sur l’économie du pays.

Il est important de noter que l'amendement de l'article 330 de l'Ordonnance sur les municipalités ne donne pas automatiquement droit à l'obtention d'une exemption pour une propriété inapte à l'utilisation, mais cette exemption dépend d'un examen objectif de l'état de la propriété. Il est également nécessaire de clarifier que la période visée de trois ans, pendant laquelle la propriété est exemptée de taxe foncière, est calculée de manière cumulée ou consécutive sur les années précédant la date de dépôt de la demande.
Par exemple, une propriété connue comme étant inapte à l'utilisation et exemptée de la taxe foncière dans les années 2013, 2014 et 2015, c'est-à-dire pour une période consécutive de trois ans, commencera à être imposée à partir du 01/01/2016 selon le taux minimal de la classification correspondant à la dernière utilisation de la propriété; Une propriété connu comme étant inapte à l'utilisation et exempte de taxe foncière par intermittence en 2013-2014 et à nouveau en 2016, commencera à être imposée dès le 01/01/2017 selon le taux minimum de la classification appropriée à la dernière utilisation des biens.

Par ailleurs, l'amendement prévoit qu'au cas où aucun changement n'intervient dans l'état d bien, après cinq années d'imposition selon le taux minimal, une déclaration doit être transmise à la ville à ce sujet, et le bien jouira une seconde fois d'une exemption complète sans limite de temps, à compter du jour de remise de la déclaration à la ville. Pour le dépôt de la requête, il est recommandé de joindre au formulaire des pièces justificatives comprenant des photos de la propriété, et le formulaire doit être rempli et le signé devant un avocat / greffier du Tribunal authentifiant la signature, ou envoyer le formulaire de contestation dûment rempli et signé.

והואיל: והצדדים מעונינים כי הספק יכין עבור החברה, באופן בלעדי וכבעל עסק עצמאי, תכשיטים לשם שיווקם ומכירתם בארץ ובחו"ל;
והואיל: ובמסגרת העבודות הייתה ו/או תהיה לספק גישה למידע הקשור לפעילותה של החברה, מידע בעל ערך וחשיבות רבה לחברה ואשר גילויו לאחרים עלול לגרום ל_____ נזק כלכלי רב;
לפיכך מצהיר ומתחייב הספק כדלהלן:

"המידע העסקי" – כמויות התכשיטים אשר יוזמנו מן הספק, שיטות השיווק והמכירה של החברה, רשימות היצרנים ו/או הספקים עמם עוסקת החברה וההסכמים עימם, בין הסכמי אספקה ורכישה ובין הסכמי סוכנות ונציגות, מחירי הרכישה ותנאי אשראי הספקים, מחירי המכירה, דרכי קבלת הזמנות, לקוחות, הכמויות הנמכרות ובדרך כלל כל המידע המסחרי והעסקי וכן כל המסמכים מכל סוג שהוא הקשורים בעסקי _______ וניהולה.
"העבודות" – הכנת התכשיטים עבור _______על ידי הספק על פי הסכם זה.
"התכשיטים" – טבעות מדגמים , אשר תמונותיהם מופיעות בנספח א' להסכם זה, אשר ייוצרו עבור החברה על ידי הספק במספר גדלים שונים, הן בזהב לבן והן בזהב צהוב.
3. הספק הנו בעל הידע, האמצעים והמומחיות לביצוע העבודות.
4. העבודות יבוצעו על ידי הספק תוך שימוש בכלים, חומרים ועובדים השייכים לו ולעסקו באופן בלעדי.
5. שעות העבודה בהן יעבוד הספק לצורך ביצוע העבודות וכמות העובדים בהם יעשה שימוש נתונים לשיקול דעתו והבנתו המקצועית ובלבד שיעמוד בלוח הזמנים לסיום העבודות אשר ייקבע על ידי החברה.

And whereas : The Supplier is the owner of a goldsmith workshop organized and existing under the laws of Israel ;
And whereas: The parties are willing that the Supplier prepare and manufacture for the Company, on an exclusive basis and as an independent business owner, jewels for the purpose of distribution and retail in Israel and abroad;
And whereas: In the context of the Operations, the Supplier had and/or will have access to information related to the Company's activity, information of great value and importance to the Company, and whose disclosure to others is likely to cause to great economic damages;
Therefore, the Supplier makes the following statements and commitments:
1. The preamble constitute an integral and inseparable part of this Agreement.
2. In this Agreement, the following terms will have the meanings assigned to them in this clause:
“Commercial Information” - the quantity of jewels purchase from the Supplier, the Company's strategies of distribution and retail, lists of manufacturers and/or suppliers collaborating with the Company and its agreements with them, such as supply and purchase agreements or agency and representation agreements, purchase prices and suppliers terms of credit, retail prices, purchase delivery methods, clients, amount of sales, and in general all business and commercial information as well as all agreements of any kind that are related to the activities of and its management.
“the Operations” - the preparation of jewels for by the Supplier pursuant to this Agreement.
“the Jewels” - rings model , whose pictures are hereby enclosed to this Agreement in Annex A, and that shall be manufactured by the Supplier for the Company in several sizes, both in white or yellow gold.
3. The Supplier has the knowledge, the resource and the expertise required to perform the Operations.
4. The Operations shall be performed by the Supplier using the tools, materials and employees belonging exclusively to him an his business.
5. The number hours the Supplier shall work in order to perform the Operations, as well as the number of employees he shall use, are left to the Supplier's discretion and professional judgment, as long as he is able to follow the Operations fulfillment time schedule that shall be determined by the Company.

Translation came to me by chance, but I've always felt destined to it.
I had once up to four passports from: Morocco (where my parents where born), Israeli (where they emigrated), Ivory Coast (where I was born) and Switzerland (where I grew up).
At home, we spoke only French, but always used Hebrew with my Family in Israel.
At School, French also, since I grew up and live in Geneva, which is in French part of Switzerland, but started learning German since I was 10 years old, then English and Italian in High school where I graduated Swiss Modern Maturity (Languages).
I went then to Law School in Geneva, where I acquired strong legal English (Willem C. Vis International Commercial Arbitration Moot) and German (Erasmus in Vienna). Used and refined those skills during a two years period as a Trainee Attorney. And since I've passed my Bar exam and started working, I have always evolved in a multilingual environment, mainly using EN and FR, drafting and translating many documents (legal, contracts, financing) in those languages, especially as Head of Legal department of a multinational Private Equity and Real Estate Company. After immigrating in Israel in 2007, I started Talmudic studies and, since I could not work as an Attorney, searched for other opportunities. Translation came to me by chance, when a neighbor asked my if I knew someone able to translate his book on dietetic and homeopathy form English to French. I did the job and love it! That lead me to many more projects and a successful carrier as a Translator, working for Publishers, Organisations, Websites and Agencies, in Israel and abroad.
