Source text - English 3 obligations incombent à l’employeur en tant qu’organisateur d’un engagement de pension :
- Communication de données complètes à l’organisme de pension : L’organisme de pension ne pourra enregistrer que les données dont il a connaissance. Il revient donc à l’organisateur, c’est-à-dire à l’employeur, de lui fournir les données les plus complètes possible sur l’engagement de pension envisagé.
- Réaction aux données enregistrées dans la DB2P : La seconde obligation de l’employeur consiste à réagir aux données enregistrées par l’organisme de pension dans la DB2P afin de les corriger et/ou les compléter si cela est nécessaire. A défaut de réaction dans un certain délai (voyez ci-dessous), l’employeur est réputé avoir validé les données renseignées par l’organisme de pension.
- Enregistrement des engagements individuels financés en interne : si ce type d’engagement existe encore dans l’entreprise, il incombe à l’employeur de les enregistrer dans la DB2P pour le 31 décembre 2014. Il faut noter que les cas sont toutefois assez rares puisqu’en ce qui concerne les travailleurs salariés, seuls subsistent à l’heure actuelle les engagements individuels de pension financés en interne contractés avant le 16 novembre 2003.
Translation - French The employer, as an organizer of a pension commitment, has 3 obligations:
- Providing the pension institution with the full information: the pension institution can only register data of which it disposes. Therefore it is the responsibility of the organizer, i.e. the employer, to provide the pension institution with the most comprehensive data available concerning the pension commitment in view.
- Responding to the data registered in the DB2P: the second obligation of the employer is responding to the data registered in the DB2P by the pension institution in order to have these data corrected and/or completed, if necessary. If he fails to do so within a certain time limit (see below), the employer shall be deemed to validate the data provided by the pension institution.
- Registering the internally funded pension commitments: if this type of commitment still exists in the company, the employer will have to register it in the DB2P on 31 December 2014 at the very latest. However, these cases are rather exceptional since for salaried workers, currently only internally funded individual pension commitments exist that were concluded before 16 November 2003.
