1. DEFINITIONS
In this Lease, the words and expressions set out hereunder shall, unless the context otherwise requires, bear the meaning respectively assigned hereunder. Words and expressions used herein but not herein defined, shall if defined in the Agreement to Lease, bear the meaning so defined, unless repugnant to the context.
“Actual Losses” means actual cost, expenses incurred and /or losses, penalties and damages suffered by a Party or caused to its property or works (including costs and expenses incurred in connection with any claims, proceedings or demands) resulting directly from the other Party’s Default but exclude loss of profits.

1. التعريفات
الكلمات والعبارات المذكورة في هذا العقد يجب أن تحمل المعنى المحدد في هذا العقد على التوالي، وذلك إذا لم يتطلب سياق النص غير ذلك. كما أن الكلمات والعبارات المستخدمة في هذا العقد ولم يتم تعريفها يجب أن تحمل المعنى الموضح في إتفاقية الوعد بالإيجار إذا تم تعريفها هناك، وذلك إذا لم تكن مخالفة لسياق النص:
"الخسائر الفعلية" تعنى التكلفة الفعلية والنفقات التي تكبدها أحد الطرفين و/أو الخسائر والغرامات والأضرار التي واجهها أو لحقت بممتلكاته أو أعماله ( بما في ذلك التكاليف والنفقات التي تكبدها فيما يتعلق بأي مطالبات أو دعاوى أو مطالب) نتجت بشكلٍ مباشر من إهمال الطرف الأخر ولكن يُستبعد من ذلك الخسارة في الأرباح.
