The key threat to the efficiency of using direct agreements in Sweden is the potential bankruptcy of the project company. The bankruptcy itself does not necessarily create significant complications for the lenders, however the expected right of the bankruptcy’s estate to enter into the debtor’s contracts exposes the lender to higher risk.
