O soluţie de compromis ar fi să-i denumim "borrower" şi "lender", adică împrumutat şi împrumutător. Este adevărat că folosirea celor doi termeni crează confuzii, iar contractul de comodat este o instituţie juridică mai rar întâlnită.

"Bailment" şi, deci, "bailor" şi "bailee" nu e deloc corect. Din definţia pe care am găsit-o pentru "bailment" rezultă că este interzis "bailee"-ului să se folosească de bun, ceea ce e total opus comodatului - împrumut gratuit de FOLOSINŢĂ.

Părţile contractului de depozit sunt deponent şi depositary; aici este vorba de un împrumut gratuit. Termenii "bailor" şi "bailee" mi se par în regulă în acest context şi se pot înlocui eventual prin "commodant" şi "commodatory".

lessor, lessee

Ţinînd seama că o traducere a contractului comodat ar fi "gratuitous loan", cred că merge să spuni "lessor" pentru comodant şi "lessee" pentru comodatar.

Pe de altă parte există şi noţiunea de "commodate", dar nu ştiu cum s-ar putea numi părţile lui.

Buna, Bogdan!Eu totusi inclin sa cred ca termenii corecti sunt bailor si bailee. Eu una am mai auzit de ei, din cate imi aduc aminte..O seara buna!Laura
Buna, Bogdan! Voiam sa te intreb daca totusi nu se pot numi partile la acest contract "commodant" şi "commodatory" pentru ca "lessor" si "lessee" i-am intalnit mai degraba in contractele de leasing.
